Abstract

This paper deals with the legal/socio-technical controversy surrounding the demarcation of the Tupinambá de Olivença Indigenous Land. The objective I sought to achieve was to identify and discuss the main arguments triggered by non-indigenous people in order to prevent the recognition of the right of indigenous peoples to their traditional lands and, on the other hand, to understand the practices of resistance and indigenous territorialization in the face of a scenario of confrontation and confinement over five centuries of friction. By imposing their presence with justice, the Tupinambá make the court a cosmopolitical arena and impose constraints on those who intend to act in detriment to the existence of other beings, preventing them from doing so in an aseptic context.
